Why a contract? 

Contracts should not over burden the buyer or seller, they should be in place to protect all parties, but mostly the puppy that is being sold.

 

Contracts should lay out obligations of the breeder (health warranties etc.) and the buyer (care and homing requirements) so no puppy is left homeless or neglected

The following agreement is between Lynai Torabpour, hereafter referred to as "Breeder" and _____________________________________________________, herafter referred to as "Buyer" for the sale and purchase of one purebred dog of the Poodle breed for the sum of 900.00 USD(nine hundred dollars). Puppy call name "XXXXX", AKC# PR12345678__ color: black, sex: . Whelped on ­­­­­__MONTH DATE YEAR,___, by Sire _________________________________________ AKC# PR17820805 and Dam ________________________________________________________

 

1. This puppy will be fed daily with quality food, given fresh water and shelter, given qualified veterinary care when needed. This dog will never be left tied up outside, unattended. 

 

2. At no time will this puppy be surrendered to animal shelter or rescue, it must be found a new home or returned to the breeder for re-homing ______buyer initials.

 

3. The Breeder will at anytime take this puppy back if asked to do so by the Buyer. No monetary cost or compensation will be expected by the Breeder to the Buyer and the Buyer will release all paperwork regarding this puppy, including AKC paperwork at the time of surrender. If the Breeder in turn, resells this puppy/dog, all proceeds minus 5.00 a day board and care and any subsequent vet/training bills will be forwarded to the original Buyer signing this contract. If board,training and/or vet bills exceed re-sale price, no money will be forwarded to the original buyer signing this contract, nor will the original buyer owe the breeder any additional funds should costs exceed re-sale price.

 

 4. Health Warranty

⦁ Puppy is warranted to the age of thirty (30) months (provided that the puppy stays intact for at least 12 months of age e.g. not spayed or neutered) against bi-lateral hip dysplasia as diagnosed by the Orthopedic Foundation of America, hereafter known as OFA. If puppy is spayed or neutered prior to 12 months of age, warranty for hips is reduced to the first year of life.

 

⦁ Puppy is warranted to the age of thirty  (30) months (provided that the puppy stays intact for at least 12 months of age e.g. not spayed or neutered) against bi-lateral elbow diysplasia, consisting of un-untied anconeal process, or fragmented coronoid process as diagnosed by the OFA. If the puppy is spayed or neutered prior to 12 months of age, warranty for elbows is reduced to the first year of life.

 

⦁ Puppy is warranted to the age of twenty four (24) months to be free of genetic cardiac conditions such as sub aortic stenosis that would keep it from receiving a passing cardiac certificat from the OFA.

 

⦁ Puppy is warranted for life against developing and/or DNA testing "affected" by By Vetgen Labratories  for the following diseases: von Willebrands, Digenerative Myleopoathy, Neonatal Encephalopathy and PRArcd.

 

⦁ The puppy is warranted to the age of 24 months against developing primary epilepsy as diagnosed by a board certified neurologist.

 

⦁ The puppy is warranted for the following cancers to the age of 5 years provided they stay intact (not spayed or neutered) for a minimum of 12 months of age; hemangiosarcoma, lymphoma, mast cell tumors. No cancer warranty on any puppy spayed or neutered prior to 12 months of age.

 

5. If a warranted problem is found and the condition can be reasonably managed by veterinarian care, supplements etc, the buyer has the option to keep their puppy (must show proof of spay/neuter) and may obtain another puppy from the Breeder in the future at 50% off the selling price. The Buyer also has the option of returning this puppy to the Breeder for a replacement puppy of equal or greater value as soon as one becomes available; at no additional charge to the buyer. All transportation costs are assumed by the buyer.

 

6. In the unlikely event that this puppy dies (or must be euthanized) from a warranted condition prior to the age of 30 months (cancer 5 years*) all veterinarian records and necropsy report performed by a certified veterinarian will be forwarded to Breeder's veterinarian, if it is determined the puppy died/or was euthanized due to a warranted condition, the puppy will be replaced with another puppy of equal or greater value as soon as one becomes available. 

 

7.Buyer agrees to have this puppy examined by a veterinarian within 4 working days of possession of this puppy. If the veterinarian determines the puppy is not in good health, the Buyer will immediately return the puppy to the Breeder (at Buyers expense) and all purchase money will be refunded to the Buyer. Puppy must be returned with all paperwork, including AKC (if applicable) registration.

 

8.All veterinarian expenses involving this puppy are assumed by the Buyer.At no time will the Breeder compensate monetarily for veterinarian expenses involving this puppy from this date______________ forward unless stated in writing on this contract.____Buyer Initials.

 

9. This puppy is sold on a Limited/no breeding rights contract, puppy must be spayed and or neutered, but not prior to 12 months of age.* If puppy is spayed or neutered prior to the age of 12 months, the cancer warranties become null and void and hip/joint warranties will be reduced to cover the first year half/18 months of life. *please note, while I extend my warranties if a dog is NOT spayed or neutered prior to 12 months of age,  I absolutely understand if you make the decision to spay or neuter earlier than the 12 months of age. Ultimately this is a decision that resides with the owner, just know the some (not all) warranties shrink a bit, and cancer warranty no longer applies if your decision is to spay and neuter prior to 12 months.

 

10. Coat color cannot be guaranteed

Worms, coccidia, giardia are common parasites but must be treated in a young puppy. The breeder has had fecal exams and has treated this puppy a minumum of 3x with both Strongid and Panacur. Subsequent worming needs are the responsibility of the Buyer.
